Nothing in this medical disclaimer will: (a)Notwithstanding anything else in this Agreement, covid-factsheet.com makes no representations or warranties of any kind, express or implied, regarding covid-factsheet.com and the information found within it and/or any content or services provided in connection with covid-factsheet.com and the information found within it and, all of which are provided on an “as is” and “as available” basis. Covid Corpus does not warrant the accuracy, completeness, currency, reliability or suitability of the operation of covid-factsheet.com and the information found within it, any content or services provided in connection with covid-factsheet.com and the information found within it or any of the content or data found on or used in connection covid-factsheet.com and the information found within it, and expressly disclaims all warranties and conditions in respect of covid-factsheet.com and the information found within it, its content, information or data, and any services or products offered in connection with covid-factsheet.com and the information found within it, including those arising by statute or otherwise in law, including, without restricting the generality of the foregoing, any warranties of merchantable quality, fitness for a particular purpose, title or non-infringement. (b) Notwithstanding any other provision of this agreement, in no event and under no circumstances will Covid Corpus or any of Covid Corpus’s directors, officers, employees, agents, independent contractors and/or other representatives be liable to the Site visitor or any other person for any damage, loss or liability whatsoever arising from, connected with or relating to this Agreement, the Project or any related matter. The foregoing liability exclusion is a comprehensive exclusion that applies to any and all damages, losses and liabilities of any nature and kind whatsoever and howsoever arising (including compensatory, direct and indirect loss and damages and liabilities), under any theory of law (including contract, tort, strict liability, statutory liability or civil law), regardless of any negligence or other fault or wrongdoing (including fundamental breach or gross negligence) by or on behalf of Covid Corpus or any person for whom Covid Corpus is responsible, even if other remedies are not available or do not compensate adequately or at all for the damage, loss or liability, and even if Covid Corpus has been advised of the possibility of the damage, loss or liability being incurred. (c) Covid Corpus is not responsible for late, lost, incomplete, illegible, misdirected, misrepresented or stolen messages, mail or other data of any kind or nature whatsoever, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, on-line failures, hardware, software or other technical malfunctions or disturbances or any other communications failures or circumstances affecting, disrupting or corrupting communications. (d) Covid Corpus assumes no responsibility, and will not be liable, whether in tort, contract or any other theory of law, equity or civil law, for any damages to, or any viruses affecting the Site visitor or Site visitor property on account of the Site visitor’s or any Site visitor User’s access to or use of, covid-factsheet.com and the information found within it or the Site visitor’s or any Site visitor User’s downloading of any materials, text, images, video, audio or other data from covid-factsheet.com and the information found within it, regardless of whether or not Covid Corpus knew or should have foreseen or known of same. (e) limit any of our liabilities in any way that is not permitted under applicable law; or (f) exclude any of our liabilities that may not be excluded under applicable law.
